Privacy Policy

Effective Date: May 4, 2026

Supersedes Version: May 12, 2020

Functionize, Inc. (“Functionize,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, and protect your information when you access the Functionize Service, including services accessed through our partner websites.

THE SANDBOX DOCTRINE

Functionize operates under a dedicated Sandbox Doctrine designed to facilitate responsible AI innovation without compromising individual privacy. We maintain strictly isolated testing and development environments, known as "sandboxes," where data is processed specifically to validate new features and ensure algorithmic fairness. Any data entering our sandbox environments is subjected to enhanced minimization protocols and is strictly segregated from our production systems to prevent unintended data leakage or unauthorized model influence. This doctrine ensures that our pursuit of cutting-edge autonomous testing remains tethered to the principles of safety, transparency, and data integrity.

1. DATA COLLECTION PRACTICES

We collect personal information that you provide directly to us when you create an account or interact with our support teams. This information typically includes your name, professional email address, job title, and company affiliation. Beyond the information you provide, our systems automatically collect technical metadata such as IP addresses, browser specifications, and platform engagement metrics through cookies and similar tracking technologies. When you utilize the Functionize Service, we also collect operational data including test execution logs and configuration settings which are essential for the delivery of our automated testing solutions.

2. DATA USE AND AI TRAINING REFINEMENT

Functionize utilizes the information we collect to operate, maintain, and enhance the functionality of our intelligent testing platform. We may use de-identified and aggregated metadata derived from platform usage to train and refine our machine learning models, which allows us to improve test accuracy and self-healing capabilities for all users. We expressly do not use raw Customer Content or proprietary application data to train models for the benefit of other customers without your explicit written consent. Your information also allows us to provide personalized customer support and to communicate essential product updates or security notifications.

3. DATA SHARING AND DISCLOSURES

We do not sell your personal information to third parties for marketing purposes. We share your data only with trusted service providers who assist us in hosting our infrastructure, analyzing platform performance, or managing customer relationships, and these providers are strictly bound by confidentiality agreements. We may also disclose information if we are required to do so by law or in response to valid legal requests by public authorities. In the event of a corporate merger, acquisition, or sale of assets, your personal information may be transferred as part of the business transition, subject to the protections outlined in this policy.

4. SYSTEM SECURITY AND INTEGRITY

Functionize employs a multi-layered security architecture designed to protect your data from unauthorized access or accidental disclosure. We utilize industry-standard encryption protocols including AES-256 for data at rest and TLS 1.2 or higher for data in transit. Our internal security program follows the principle of least privilege, ensuring that access to production environments is restricted to a limited number of authorized personnel. Furthermore, we maintain a rigorous audit schedule and adhere to SOC 2 Type II compliance standards to verify the ongoing effectiveness of our security controls.

5. DATA RETENTION LIFECYCLE

We retain your personal information only for the duration necessary to fulfill the purposes described in this policy or as required by our legal and contractual obligations. For active accounts, we maintain your data to ensure the continuity of your testing history and platform configurations. Upon the termination of your relationship with Functionize, we initiate a standardized decommissioning process to delete or anonymize your data within a reasonable timeframe, typically not exceeding sixty days. We may retain certain information for longer periods if it is necessary to comply with tax laws, resolve legal disputes, or enforce our corporate agreements.

6. INDIVIDUAL DATA RIGHTS

Depending on your geographic location, you may possess specific rights regarding your personal information under frameworks such as the GDPR or CCPA. These rights may include the ability to access a copy of the data we hold about you, the right to request the correction of inaccurate information, and the right to request the deletion of your data under certain conditions. You may also have the right to object to or restrict the processing of your data, particularly in relation to automated decision-making or direct marketing. To exercise any of these rights, you may submit a formal request to our privacy team at the contact address provided below.

7. PROTECTION OF CHILDREN'S PRIVACY

The Functionize platform is a business-to-business service intended for use by professionals and is not directed toward individuals under the age of sixteen. We do not knowingly collect personal information from children, and our terms of service prohibit the use of the platform by minors. If we become aware that we have inadvertently collected personal data from a child, we will take immediate steps to delete that information from our servers and terminate any associated accounts.

8. NOTIFICATION OF CHANGES AND UPDATES

We will inform you of any material changes to this Privacy Policy through formal notification channels to ensure ongoing transparency. Notifications may be delivered via a prominent announcement on our website, a direct email to the primary contact on your account, or a notification within the Service interface itself. We encourage you to review the "Effective Date" at the top of this policy regularly to stay informed about how we are evolving our privacy practices in response to new technologies and regulatory requirements.

9. RIGHT TO AMEND AND FUTURE MODIFICATIONS

Functionize reserves the unilateral right to modify, update, or revise this Privacy Policy at any time to reflect changes in our business practices or legal obligations. Any such modifications will become effective immediately upon their publication on our website. Your continued use of the Service following the posting of an updated policy constitutes your formal acknowledgment and acceptance of the revised terms. We maintain the right to adapt our data processing activities as AI technologies and privacy standards continue to mature.
